1. Overview

Welcome to Pixy. Pixy is an AI-powered personal assistant that generates contextual, personalized interfaces by connecting your apps, data, and daily routines into one fluid experience.

By accessing or using Pixy (including our website, mobile application, and any related services), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use Pixy.

2. Account Registration

To use Pixy, you must create an account. You agree to:

Be at least 13 years of age (or the minimum age required in your jurisdiction)
Provide accurate, current, and complete information during registration
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activity that occurs under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

3. License to Use Pixy

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Pixy for your personal, non-commercial purposes.

This license does not include the right to sublicense, sell, resell, or commercially exploit any aspect of Pixy. We reserve all rights not expressly granted to you.

4. Prohibited Conduct

You agree not to:

Use Pixy for any illegal purpose or in violation of any applicable laws
Infringe upon or violate the intellectual property rights of others
Harass, abuse, threaten, or intimidate other users
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Pixy
Scrape, mine, or use Pixy's content or outputs to train AI or machine learning models
Attempt to bypass, disable, or circumvent any security features or access controls
Use automated systems, bots, or scripts to access Pixy without our express written permission
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload, transmit, or distribute any malware, viruses, or other harmful software
Use Pixy in any way that could damage, disable, overburden, or impair our servers or networks

5. Your Content

You retain all ownership rights in the content you provide to Pixy ("Your Content"), including text, images, voice recordings, and data from connected integrations.

By using Pixy, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display Your Content solely for the purpose of providing, improving, and maintaining the Pixy service. We will not sell Your Content or use it for purposes unrelated to the service.

You are responsible for ensuring you have the right to share any content you provide to Pixy, including content from third-party integrations.

6. AI-Generated Content

Pixy uses artificial intelligence to generate responses, suggestions, interfaces, and other outputs ("AI-Generated Content"). You acknowledge and agree that:

AI-Generated Content is provided "as-is" and may contain errors, inaccuracies, or biases
AI-Generated Content may not be eligible for copyright protection under applicable law
You should review and verify AI-Generated Content before relying on it for important decisions
The AI models and providers powering Pixy may change over time, which could affect outputs
We do not guarantee the accuracy, completeness, or reliability of any AI-Generated Content

7. Third-Party Services

Pixy integrates with third-party services such as Google (Gmail, Calendar), Notion, Strava, and others. When you connect these services:

Your use of those services remains subject to their respective terms of service and privacy policies
We are not responsible for the availability, accuracy, or functionality of third-party services
You authorize Pixy to access and process data from connected services on your behalf
You may disconnect integrations at any time through your account settings

We do not endorse and are not liable for any third-party services or their content.

8. Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of Pixy shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

The arbitration will be conducted under the rules of the American Arbitration Association (AAA) and shall take place in the State of Delaware, unless otherwise agreed upon by the parties.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO PIXY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

PIXY IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

You may terminate your account at any time by contacting us or through your account settings.

We may suspend or terminate your access to Pixy at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, fraudulent activity, or extended periods of inactivity.

Upon termination, your right to use Pixy will immediately cease. Provisions of these Terms that by their nature should survive termination (including limitation of liability, dispute resolution, and intellectual property provisions) shall survive.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the service.

Your continued use of Pixy after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using Pixy and close your account.
